Rostie & Associates is committed to protecting personal information in a manner that is confidential, secure, and responsible. This Policy will explain how personal information is to be used, collected, stored, and disclosed. Application This Policy applies to every branch office of Rostie & Associates including Toronto and Boston. It is Rostie & Associates' policy to comply with privacy legislation within each jurisdiction in which we operate. This Policy covers only those activities that are subject to the provisions of Canada's federal and provincial privacy laws, as applicable. This Policy has a limited scope and application and the rights and obligations contained in this Policy may not be available to all individuals or in all jurisdictions. This Policy does not create or confer upon any individual any rights, or impose any obligations This Policy governs the collection, use and disclosure of personal information by Rostie & Associates from and about individuals who are not employed by Rostie & Associates II. What is Personal Information? "Personal information" is defined in s.2 of PIPEDA as: information about an identifiable individual, but does not include the name, title or business address or telephone number of an employee of an organization. III. What Do We Use Your Information For? Rostie & Associates collects, uses, and discloses candidates' personal information to aid candidates in their search for employment. Personal information may also be used by Rostie & Associates to communicate with candidates and for internal statistical purposes. Your personal information will not be disclosed to any potential employer without your prior written consent. Your personal information will not be distributed or sold to any company or person(s) for any purpose other than those stated above. IV. What Information Do We Collect? (a) Personal Information We Collect We collect, use, and disclose personal information including but not limited to the following: * Name * Home contact information * Employer * E-mail address * Current Salary * Employment History including annual reviews, list of clients/transactions * CV * Academic History and transcripts * Interview notes and Personal Evaluation by one or more Rostie & Associates consultant(s) * History of jobs/employers that the CV has been submitted to * Correspondence and/ or emails between candidates and Rostie & Associates Information necessary for payroll, only where applicable, including Social Insurance Number and direct deposit bank account information All of this above-listed information, along with any other submitted information related to your employment search, may be entered onto our company database. (b) On Our Website You can visit our website (www.rostie.com) without telling us who you are or revealing any information about yourself, including your e-mail address. In this case, our Web server may collect the IP address and domain used to access our site, the type and version of your browser, the website you came from to access our site, the page you entered and exited at and what country you are from. This information is used by us to measure the number of visits, average time spent, page views and other statistics about our site in general. We also use this information to monitor our site's performance and for administration purposes such as continually upgrading our site. If you apply for a position on our website, you will be revealing (at a minimum) your name, e-mail address, employer, and your current CV, along with any other personal information you choose to submit. The information you submit to our website may be entered onto our database. Your information will not be disclosed to anyone other than Rostie & Associates employees without your express consent. V. Who Has Access to Your Information? All consultants and administrative staff of Rostie & Associates will have access to your personal information through our company database. Rostie & Associates employees that have access to your personal information are instructed that it is to be used only in adherence with the principles set forth in this Policy and PIPEDA. Rostie & Associates reserves the right to change database software and maintenance companies. VI. Consent (a) At Our Offices When you first arrive at a Rostie & Associates office, you will be presented with an Interview Form. This form contains a series of questions that must be answered before Rostie & Associates will take you on as a candidate. As well, you will be given a Consent Form which you must sign. This Consent Form allows Rostie & Associates to collect and use your personal information and to store your information in our database. (b) Unsolicited Personal Information If you submit a CV and/or other personal information by mail, fax, or e-mail, whether in response to an advertisement or to Rostie & Associates in general, you will be implicitly consenting to the use, collection, and disclosure of that information, through our database, by all Rostie & Associates consultants and administrative staff. VII. How Long Do We Keep Your Information? Rostie & Associates will retain your personal information for 5 years, after which time we will archive it, if you do not consent to its continued collection, use, and disclosure. We retain any personal information relating to payroll and accounting matters in accordance with accounting principles and applicable legislation. If you would like your information archived before 5 years please contact your consultant or Cynthia Rostie, Owner (crostie@rostie.com) VIII. Protecting Personal Information We understand the importance of protecting personal information. For that reason, we have taken the following steps: 1. Our premises are monitored with an alarm and only Rostie & Associates employees have access to our offices. 2. Electronic hardware is either under supervision or secured in a locked or restricted area at all times. In addition, passwords are used on all computers and our database. 3. Staff are trained to collect, use and disclose personal information only as necessary to fulfill their duties and in accordance with our privacy policy. IX. You Can Look at, Correct and Update Your Personal Information You have the right to see your personal information held by Rostie & Associates. We will need to confirm your identity before providing you with any information. We reserve the right to charge a nominal fee for such requests. If you would like to see your personal information you must contact your consultant or Cynthia Rostie, Owner (crostie@rostie.com). All requests for information must be made in writing. We will respond to your request within thirty days. If you believe there is a mistake in the information, you have the right to ask for it to be corrected and/or updated. This applies to factual information and not to any professional opinions we may have formed. We may ask you to provide documentation that our files are wrong. Where we agree that we made a mistake, we will make the correction and notify anyone to whom we sent this information. If we do not agree that we have made a mistake, we will still agree to include in our file a brief statement from you on the point and we will forward that statement to anyone else who received the earlier information. If you wish to make a formal complaint about our privacy practices, you may make it in writing to our Privacy Officer. She will acknowledge receipt of your complaint, ensure that it is investigated promptly and that you are provided with a formal decision and reasons in writing. For more general inquiries, the Privacy Commissioner of Canada oversees the administration of the privacy legislation in the private sector. The Commissioner also acts as a kind of ombudsman for privacy disputes.
